Do Agency Chefs Need a DBS Check Even When the Agency Says It Is Done?

Do agency chefs need a DBS check? Usually, yes, but which level applies depends on where that chef is working, not what it says on their job title. A chef booked into a care home purely to prepare meals needs a different check to the same chef assisting residents with eating on the same shift. Move that chef into a school kitchen instead, and the check required changes again, based on how often they are booked there rather than what kind of chef they are. The setting decides the check. The job title decides almost nothing.

For the manager who booked that chef through an agency, the harder part usually isn’t the check itself. It’s knowing which level actually applies to your setting, and being certain the agency holds evidence of it rather than a reassurance that it exists somewhere.

The Two Legal Regimes Behind the Question

Two separate pieces of law sit underneath this question, and conflating them is where most confusion starts. The Safeguarding Vulnerable Groups Act 2006 defines regulated activity, and that definition decides whether someone is eligible for an Enhanced check with a barred list check in the first place. Eligibility isn’t a judgement call an agency or a venue gets to make on the day. It follows the legal definition of what the role actually involves.

CQC Regulation 19, under the Health and Social Care Act 2008 regulations, is a different thing entirely. It governs a registered provider’s own recruitment duties, and it applies regardless of what a DBS check does or doesn’t confirm. One law decides what check a person can legally have. The other decides who is responsible for making sure that check exists and is fit for the role. Getting the DBS level right does not automatically mean the Regulation 19 duty has been met. Meeting Regulation 19 does not, by itself, confirm the DBS level was correct either.

Does the Check Follow the Chef or the Booking?

The booking, not the chef. This catches out venues who assume that once an agency chef has “a DBS,” that certificate covers every placement they ever work. It doesn’t. A chef who holds an Enhanced check with a barred list check from a school placement isn’t automatically cleared to the same standard for a care home shift where they’ll be assisting residents to eat. The specific duties of the role, not the person’s history, are what regulated activity turns on. Each booking has to be assessed on what that chef will actually be doing there, not on what they did last time.

What Level of Check Applies in a Care Home

Food preparation only, with no direct contact assisting residents, calls for an Enhanced check without a barred list check. That’s the position under gov.uk’s DBS eligibility guidance for care settings where the role doesn’t meet the regulated activity threshold.

Where the same chef also regularly assists residents to eat, or transports them, the picture changes. That crosses into regulated activity under the Safeguarding Vulnerable Groups Act 2006, and the requirement becomes Enhanced with the adults’ barred list. Two chefs doing work that looks similar from the outside, in the same building, can legitimately need different levels of check. That isn’t an inconsistency to fix. It’s the law working as intended.

What Level of Check Applies in a School

Frequency is what determines this one. A chef booked for more than three days in any thirty day period, or once a week or more, needs an Enhanced check with the children’s barred list check completed before they start, regardless of how closely they’re supervised on site. Below that frequency, an Enhanced check without the barred list check applies instead. A single one-off cover shift and a standing weekly booking are not the same risk, and Keeping Children Safe in Education treats them differently for exactly that reason.

What Level of Check Applies in a Hotel or Hospitality Venue

There is no legal requirement here at all. A Standard or Enhanced check isn’t mandated for a hotel or general hospitality kitchen, since the setting doesn’t involve regulated activity with children or vulnerable adults. A Basic check can be requested if a venue wants one as a matter of its own policy, but that’s a choice, not a compliance obligation.

One point matters here regardless of setting. Barred list checks are only available at Enhanced level. A Standard check, wherever it’s used, does not confirm someone isn’t barred. Full stop.

Why the Venue Stays Accountable Under Regulation 19

This is the part that catches venues out, and it deserves proper space rather than a passing line. Under Regulation 19, the definition of a person employed for the purposes of safe recruitment duties extends to contractors and agency staff, not just people on your own payroll. A registered care provider carries the Regulation 19 duty for an agency chef exactly as it would for someone employed directly, even though the agency is the one that actually ran the DBS check.

That isn’t a technicality. It means responsibility for confirming a check is appropriate and evidenced sits with you, the registered provider, and it does not move to the agency just because the agency did the practical work of obtaining it. CQC guidance on Regulation 19 is built around this point specifically, that outsourcing the process of getting a check does not outsource the duty to be satisfied that check is right. If an inspection asks to see evidence for an agency worker’s file, “the agency told us it was done” is not the answer that closes that conversation.

Is Being Told the Check Has Been Done Enough?

No. A DBS certificate is issued to the individual, not to the employer or the agency that arranged it, which means an email from an agency confirming a check is complete is not the same thing as evidence that it is. Someone at the venue, or someone at the agency who can show you the record, needs to have actually seen the certificate itself, or a verified check through the DBS Update Service. A verbal or written assurance with nothing behind it leaves a gap between what you’ve been told and what you could actually produce if asked to prove it.

Can an Existing DBS Certificate Be Reused?

Sometimes, and it’s worth checking properly rather than assuming. If a chef is subscribed to the DBS Update Service, an existing certificate can be reused for a new role, but only where that new role sits at the same check level and the same workforce type as the certificate originally issued. A certificate obtained for adult workforce food preparation duties isn’t automatically valid for a children’s workforce placement in a school, even if the person is subscribed to the Update Service. Checking eligibility for reuse is a specific step. It doesn’t tick itself just because someone once had a DBS check done somewhere else.

DBS certificates themselves carry no expiry date in law. Where a care provider or school sets a renewal point, twelve months is common, that’s an internal policy decision, not a legal requirement, and it’s worth knowing which one your own setting has adopted rather than assuming a fixed rule exists nationally.

Confirm Your Own Position Before the Shift

Exactly which level applies to a specific booking depends on the precise duties of that role. That’s a conversation worth having directly with your safeguarding lead or registered manager before the shift is confirmed, rather than assumed from a previous placement that looked similar. Right to work checks and food hygiene requirements sit alongside this as separate obligations, worth confirming in their own right, but they aren’t the subject here.
